At the first hearing of the suit the court is required to ascertain from each party or his pleader whether he admits or denies such allegations of fact as are made in the plaint or written statement of the opposite party and as are not expressly or by necessary implication admitted or denied by the party against whom they are made . वाद की पहली सुनवाई पर न्यायालय को प्रत्येक पक्ष अथवा उसके वकील से यह पूछना होता है कि वह वादपत्र या विरोधी पक्ष के लिखित कथन में दिए गए तथ्य के अभिकथनों को स्वीकार करता है या नकारता है . यही प्रश्न उन अभिकथनों के बारे में भी किया जाता है जो विरोधी पक्ष ने किए हैं पर दूसरे पक्ष ने उन्हें स्पष्टत : अथवा आवश्यक विवक्षा के द्वारा स्वीकारा अथवा नकारा नहीं है .
